Court overturns ruling blocking The Tor Project site in Russia and refers case for reconsideration

The appellate court quashed the decision of the Saratov District Court, under which the main site The Tor Project was blocked. «Роскомсвобода» reports.

As ForkLog reported, lawyer Ekaterina Abashina said that procedural violations formed the basis for the reversal. Specifically, the first-instance court did not involve The Tor Project Inc. in the proceedings.

Nevertheless, the case was sent for reconsideration with the site’s owner participating.

In a conversation with ForkLog, a Roskomsvoboda lawyer said the prosecutor is seeking to restrict access to the site due to “information enabling users to download the anonymising browser”.

«We insist that such information is neither prohibited nor restricted by RF law, directly or indirectly; there is no administrative or criminal liability for the dissemination of such information, therefore there are no legal grounds for restricting it,» Abashina said.

A hearing on The Tor Project case is scheduled for May 26.

In December last year, specialists recorded the blocking of access to the Tor network within the Russian Federation.

The Tor Project Inc., the operator of the Tor network, reported receiving a letter from Roskomnadzor threatening to restrict access due to information prohibited in the territory of the Russian Federation. The formal basis was the Saratov District Court’s 2017 decision.

Roskomsvoboda appealed the blocking on behalf of Tor Project Inc.
