French regulator orders Clearview AI to delete French citizens’ data

The French data protection regulator the CNIL has ordered the facial-recognition developer Clearview AI to delete all data relating to French citizens and to stop collecting further data.

In May 2020, after numerous complaints from individuals, the agency opened an investigation into the company. During the proceedings, the CNIL identified two GDPR violations:

• unauthorized collection and processing of biometric data;
• the company’s failure to comply with citizens’ requests to delete personal information.

The CNIL chair ordered Clearview AI to comply with the commission’s demands within two months. Otherwise, the regulator warned, it could face fines.

The company says it believes its activities do not fall under the GDPR.

In November, the Office of the Australian Information Commissioner required Clearview AI to cease collecting photographs of citizens.

In April, a U.S. senator proposed legislating to ban government agencies from purchasing biometric data from private companies without a court order.

In February, Canadian regulators accused Clearview AI of unlawful data collection and recommended ceasing services in the country.
