A New York court has scheduled a preliminary hearing in the BitMEX founders’ case for March 28, 2022, according to Law360.
The defendants are former BitMEX CEO Arthur Hayes, and the platform’s co-founders Samuel Reed and Ben Delo.
In October 2020 the U.S. Commodity Futures Trading Commission filed a complaint against BitMEX. Additionally, the Department of Justice charged Hayes, Delo, Reed and Greg Dwyer, the company’s head of business development, with violations of the Bank Secrecy Act.
In the same month BitMEX announced a leadership change — Hayes and Reed left their posts. Reed was released on bail of $5 million.
In March 2021 Bloomberg reported on Delo’s voluntary surrender and his release on bail of $20 million.
In April, Hayes was released on bail of $10 million, secured by $1 million in cash and his mother’s guarantees.
