Quentin Tarantino seeks to dismiss Miramax NFT lawsuit

The director Quentin Tarantino has asked the Los Angeles court to dismiss Miramax’s lawsuit over an NFT collection based on the film Pulp Fiction. This is reported by Law360.

In Tarantino’s view, Miramax’s claim ‘ignores the clear wording’ in the agreements. Under the agreements, the director is entitled to publish film-related print material, including publishing scripts, creating books or comics, and other interactive publications.

“The film’s script is an original work protected by copyright, preceding the film, and the exclusive rights to the script, including such elements as dialogues, characters, plot and descriptions of scenes, belong to the author of the script,” Friedman emphasised.

In the filing, Miramax’s copyrights extend to elements of the film not included in the script.

According to Reuters, Miramax lawyer Kyle Kasatsa stated that the original agreement grants the studio ‘all rights (including copyrights and trademarks) to the film (and its elements at all stages of development and production).’

In November 2021 Tarantino announced an NFT auction based on “Pulp Fiction.” The full collection contains seven tokens with chapters from the director’s original handwritten script and his exclusive audio commentaries.

Miramax filed suit against Tarantino with accusations of unfair competition, breach of contract and copyright infringement.

In January 2022 the decentralized autonomous organization AnonDAO won the auction and bought the token Royale with Cheese for $1.1 million.

As noted, director Spike Lee saw the potential in NFTs for the film industry.
