This was stated in a <a href=\"https:\/\/download.asic.gov.au\/media\/m0bfzbyx\/24-283mr-asic-v-binance-australia-derivatives-statement-of-claim-sealed.pdf\">lawsuit<\/a> filed by the <span data-descr=\"Australian Securities and Investments Commission\" class=\"old_tooltip\">ASIC<\/span>.<\/p>\n<p>According to the complaint, from July 2022 to April 2023, Oztures Trading Pty Ltd (trading as Binance Australia Derivatives) mistakenly classified 505 clients\u201483% of its users\u2014as &#8220;wholesale&#8221; investors.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201c[\u2026] Binance failed to ensure the efficiency, honesty, and fairness of the financial services provided under its Australian license. Many clients suffered significant losses,\u201d stated the agency&#8217;s <a href=\"https:\/\/asic.gov.au\/about-asic\/news-centre\/find-a-media-release\/2024-releases\/24-283mr-asic-sues-crypto-company-binance-australia-derivatives-for-consumer-protection-failures\/?altTemplate=betanewsroom\">press release<\/a>.<\/p>\n<\/blockquote>\n<p>ASIC claims that users were not afforded the same protections as lower-income investors, including the right to receive disclosure statements and access to a dispute resolution system.<\/p>\n<p>The commission noted that in 2023, it had already overseen compensation payments from the exchange to affected clients amounting to approximately 13 million <span data-descr=\"Australian dollars\" class=\"old_tooltip\">AUD<\/span> (~$8.3 million).<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cCryptocurrency derivatives are inherently risky and complex, making it crucial for retail clients to be correctly classified. These classifications ensure they receive consumer protections and the information necessary to make informed investment decisions,\u201d emphasized the regulator&#8217;s representatives.<\/p>\n<\/blockquote>\n<p>ASIC intends to seek through the courts \u201cpenalties, as well as declarations and orders for the dissemination of corrective information\u201d against Binance.<\/p>\n<p>In April 2023, the commission revoked the local branch&#8217;s license due to improper client classification.
