{"id":21750,"date":"2025-03-05T13:01:25","date_gmt":"2025-03-05T11:01:25","guid":{"rendered":"https:\/\/forklog.com\/en\/eu-regulator-confirms-mica-does-not-ban-usdt-transactions\/"},"modified":"2025-03-05T13:01:25","modified_gmt":"2025-03-05T11:01:25","slug":"eu-regulator-confirms-mica-does-not-ban-usdt-transactions","status":"publish","type":"post","link":"https:\/\/forklog.com\/en\/eu-regulator-confirms-mica-does-not-ban-usdt-transactions\/","title":{"rendered":"EU Regulator Confirms MiCA Does Not Ban USDT Transactions"},"content":{"rendered":"<p>The storage and transfer of stablecoins not compliant with MiCA do not violate EU laws, stated a representative of the <span data-descr=\"European Securities and Markets Authority\" class=\"old_tooltip\">ESMA<\/span> in a comment to <a href=\"https:\/\/cointelegraph.com\/news\/european-securities-and-markets-authority\">Cointelegraph<\/a>.<\/p>\n<p>The regulator clarified the status of &#8220;stablecoins&#8221; following <a href=\"https:\/\/forklog.com\/en\/news\/binance-to-delist-usdt-and-other-non-mica-compliant-stablecoins\">Binance&#8217;s announcement<\/a> of delisting USDT and eight other assets within the <span data-descr=\"European Economic Area\" class=\"old_tooltip\">EEA<\/span>.<\/p>\n<p>ESMA explained that services related to the storage and transfer of stablecoins are not considered a &#8220;public offering&#8221; or &#8220;admission to trading.&#8221; <\/p>\n<p>The MiCA rules do not impose a direct ban on dealing with assets that do not comply with its provisions, the agency&#8217;s representative emphasized.<\/p>\n<p>ESMA specified that European <span data-descr=\"crypto-asset service providers\" class=\"old_tooltip\">CASP<\/span> should &#8220;primarily restrict services facilitating the purchase&#8221; of such assets, referring to guidance <a href=\"https:\/\/www.esma.europa.eu\/sites\/default\/files\/2025-01\/ESMA75-223375936-6099_Statement_on_stablecoins.pdf\">issued<\/a> on January 17, 2025.<\/p>\n<p>At the same time, the regulator permitted a temporary &#8220;sell-only and withdrawal&#8221; regime, allowing investors to close positions by the end of March.<\/p>\n<p>Back in December 2024, MiCA Crypto Alliance technical committee member Juan Ignacio Ib\u00e1\u00f1ez <a href=\"https:\/\/forklog.com\/en\/news\/usdts-legal-status-under-mica-remains-uncertain\">stated<\/a> that the absence of prohibitions does not render USDT legal under MiCA.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The storage and transfer of stablecoins not compliant with MiCA do not violate EU laws, stated a representative of the ESMA in a comment to Cointelegraph.
