{"id":23930,"date":"2025-05-13T12:48:07","date_gmt":"2025-05-13T09:48:07","guid":{"rendered":"https:\/\/forklog.com\/en\/expert-comments-on-ens-1-2-billion-ruble-lawsuits-against-bitriver\/"},"modified":"2025-05-13T12:48:07","modified_gmt":"2025-05-13T09:48:07","slug":"expert-comments-on-ens-1-2-billion-ruble-lawsuits-against-bitriver","status":"publish","type":"post","link":"https:\/\/forklog.com\/en\/expert-comments-on-ens-1-2-billion-ruble-lawsuits-against-bitriver\/","title":{"rendered":"Expert Comments on En+&#8217;s 1.2 Billion Ruble Lawsuits Against BitRiver"},"content":{"rendered":"<p>En+ entities are engaged in legal battles with Russian data center operator BitRiver, seeking over 1.21 billion rubles in two separate cases, according to <a href=\"https:\/\/www.kommersant.ru\/doc\/7713207\">Kommersant<\/a>.\u00a0<\/p>\n<p>In late April, the Arbitration Court of the Irkutsk Region granted <a href=\"https:\/\/mkad.arbitr.ru\/card\/c8d3e6d4-5609-4798-b686-f6b0134b0037\">a claim<\/a> by \u201cInfrastructure of Siberia\u201d (part of En+) to recover 954.4 million rubles from GC \u201cFox,\u201d which owns 49% of UK \u201cBitRiver.\u201d As part of the dispute, the defendant&#8217;s funds and equipment have been seized, preventing their use. The equipment is pledged to the plaintiff to ensure the fulfillment of supply obligations.<\/p>\n<p>Another En+ entity, \u201cBit+,\u201d <a href=\"https:\/\/mkad.arbitr.ru\/card\/592837af-4f4d-4747-b3c8-4b4f4fa333f9\">demands<\/a> 256.7 million rubles from \u201cBitRiver Rus.\u201d An arrest has also been placed on the defendant&#8217;s accounts within this amount. According to the Federal Tax Service, operations on the accounts of \u201cBitRiver Rus\u201d and LLC \u201cStroyservice Plus,\u201d which owns 49% of UK \u201cBitRiver,\u201d have been suspended.<\/p>\n<p>In April, the registry of legally significant information published a notice from the collection agency \u201cID Collect\u201d about its intention to file for the bankruptcy of \u201cStroyservice Plus.\u201d<\/p>\n<h2 class=\"wp-block-heading\"><strong>The Essence of the Claims<\/strong><\/h2>\n<p>BitRiver owns 15 data centers with a total capacity of over 533 MW, housing more than 175,000 pieces of equipment.\u00a0<\/p>\n<p>In 2020, En+ Group and BitRiver established a joint venture, \u201cBit+.\u201d The former was responsible for supplying electricity to the Bratsk site, while the latter managed its operations. According to <a href=\"https:\/\/spark-interfax.ru\/irkutskaya-oblast-bratsk\/ooo-bit-inn-3804113105-ogrn-1193850019725-8d9c577680de8d0fe0531c9aa8c0b969\">EGRUL<\/a>, BitRiver exited the project in April 2025, transferring 20% to En+. The latter became the sole founder of \u201cBit+.\u201d<\/p>\n<p>As explained by \u201cInfrastructure of Siberia,\u201d they entered into a contract with GC \u201cFox\u201d for the supply of equipment and made an advance payment. Not receiving the devices, they terminated the deal and sued to recover the advance and claim penalties for the delay.<\/p>\n<h2 class=\"wp-block-heading\"><strong>BitRiver&#8217;s Position<\/strong><\/h2>\n<p>BitRiver&#8217;s owner and CEO, Igor Runets, asserts that the equipment was delivered and GC \u201cFox\u201d is appealing the court&#8217;s decision. According to him, one aspect of the dispute with En+ involves the shutdown of BitRiver&#8217;s mining data centers in December last year in northern Irkutsk Region.\u00a0<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cToday they are operating normally, but the shutdowns in December caused significant losses to several group companies, including \u2018BitRiver Rus\u2019 and \u2018Stroyservice Plus,\u2019 which we also plan to recover from En+ through legal proceedings,\u201d stated Runets.\u00a0<\/p>\n<\/blockquote>\n<p>Additionally, the <span data-descr=\"Federal Antimonopoly Service\" class=\"old_tooltip\">FAS<\/span> is investigating potential violations of competition law by the Irkutsk Electric Grid Company, part of En+.<\/p>\n<p>Kommersant, citing sources, writes that BitRiver should have the funds to cover the entire amount of the claims. In 2024, \u201cBitRiver Rus\u201d revenue grew by 9.9% to 10.28 billion rubles, and net profit increased by 71.1% to 202.21 million rubles. According to BitRiver, the group&#8217;s total revenue in 2024 exceeded 17 billion rubles.<\/p>\n<p>Igor Runets emphasized that BitRiver&#8217;s financial position is stable and all equipment in the data centers is operational. No enforcement measures are applied to GC \u201cFox,\u201d and \u201cStroyservice Plus\u201d continues its operations without difficulties, he added.<\/p>\n<h2 class=\"wp-block-heading\"><strong>Threat to Scaling<\/strong><\/h2>\n<p>In a comment to ForkLog, Roman Zabuga, CEO and co-owner of Argentine data center operator Dimalessi S.R.L., stated that the energy companies&#8217; claims might be justified, but \u201cbefore En+, all similar conflicts were resolved amicably.\u201d\u00a0<\/p>\n<p>According to him, Oleg Deripaska&#8217;s entities are BitRiver&#8217;s main energy partners.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cIt is unlikely that En+&#8217;s withdrawal from partnerships means the operator will lose all business in the country. However, it is quite likely that scaling the business in such partnerships will no longer be possible for Russia&#8217;s largest mining infrastructure operator,\u201d noted Zabuga.<\/p>\n<\/blockquote>\n<p>He stressed that the previously announced construction of a <span data-descr=\"data processing center\" class=\"old_tooltip\">DPC<\/span> with the <span data-descr=\"Russian Direct Investment Fund\" class=\"old_tooltip\">RDIF<\/span> in BRICS countries is \u201cunfeasible,\u201d as due to US sanctions, the BitRiver group is on the \u201cblack\u201d lists of most countries.\u00a0<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cOptions outside Russia include Ethiopia, Saudi Arabia, Qatar, Vietnam, and Mongolia. The latter involves supplying eco-fuel (hydrogen, methane) to Europe, where German entities are actively working. Whether there is room for a sanctioned company is a big question,\u201d Zabuga speculates.<\/p>\n<\/blockquote>\n<p>Despite En+ purchasing mining equipment, neither it nor its affiliated companies are legally allowed to mine, the expert added.\u00a0<\/p>\n<div class=\"wp-block-text-wrappers-keypoints article_keypoints\">\n<p>According to the <a href=\"https:\/\/forklog.com\/en\/news\/russia-legalises-cryptocurrency-mining-implications-for-the-industry\">mining law<\/a> adopted in Russia, combining cryptocurrency mining with activities in the electricity sector is not permitted.<\/p>\n<\/div>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cFurther questions arise, answers to which may lead to conspiracy theories involving business nationalization. This is not good for BitRiver or other market participants,\u201d concluded Zabuga.<\/p>\n<\/blockquote>\n<p>Back in April 2022, the US Treasury imposed sanctions against the BitRiver group.
