{"id":25276,"date":"2025-07-11T19:00:00","date_gmt":"2025-07-11T16:00:00","guid":{"rendered":"https:\/\/forklog.com\/en\/czechias-bitcoin-scandal-money-laundering-or-mere-mismanagement\/"},"modified":"2025-07-11T19:00:00","modified_gmt":"2025-07-11T16:00:00","slug":"czechias-bitcoin-scandal-money-laundering-or-mere-mismanagement","status":"publish","type":"post","link":"https:\/\/forklog.com\/en\/czechias-bitcoin-scandal-money-laundering-or-mere-mismanagement\/","title":{"rendered":"Czechia\u2019s bitcoin scandal: money-laundering or mere mismanagement?"},"content":{"rendered":"<p>In mid-June the Czech parliamentary opposition tabled a no-confidence motion against the government after the Ministry of Justice sold nearly 500 BTC donated by a convicted criminal (~$45m at the time of sale).<\/p>\n<p>ForkLog examines how the scandal could reshape the country\u2019s political landscape.<\/p>\n<h2 class=\"wp-block-heading\"><strong>Background<\/strong><\/h2>\n<p>The affair is closely tied to the investigation of the darknet marketplace <a href=\"https:\/\/en.wikipedia.org\/wiki\/Sheep_Marketplace\" target=\"_blank\" rel=\"noopener\" title=\"\">Sheep Marketplace<\/a>. Launched in March 2013, it quickly gained local traction after Silk Road\u2019s closure, offering a similar range of illicit goods and services.<\/p>\n<p>But by December that year the anonymous marketplace shut down following the theft of 5,400 BTC (~$6m at the time) by one of its vendors.<\/p>\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh7-qw.googleusercontent.com\/docsz\/AD_4nXcFjhERErIWPmEKeE5-W6aIDrQwXl1U8beDl8CcDpWY7dpVY8ankr_jGFWvaj-JvRfb3pUIhX55lUiwYB6GE491nLlqIJ6rz62yAwblWnlJulllFMmzYQEpybZKNrG0SIr8nhrpVg?key=Y28qzmaqJ1Z-tP6GL8WUew\" alt=\"Czechia\u2019s bitcoin scandal: money-laundering or mere mismanagement?\"\/><figcaption class=\"wp-element-caption\">Data: Marigold.cz.<\/figcaption><\/figure>\n<p>Several years later two Florida residents, Shaun McCarty and Nathan Gibson, were <a href=\"https:\/\/www.justice.gov\/usao-mdfl\/pr\/more-17-million-forfeited-funds-presented-law-enforcement-agencies\" target=\"_blank\" rel=\"noopener\" title=\"\">found guilty<\/a> of stealing Sheep Marketplace\u2019s assets.<\/p>\n<p>The marketplace\u2019s creator, Czech programmer Tom\u00e1\u0161 Jir\u00edkowsk\u00fd, was arrested in spring 2016. He was charged with stealing roughly 40,000 BTC during Sheep Marketplace\u2019s exit scam, drug trafficking and illegal arms possession. In 2017 Jir\u00edkowsk\u00fd received a nine-year sentence.<\/p>\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh7-qw.googleusercontent.com\/docsz\/AD_4nXeRECirSW_gP2ZxNup4E8V_TOshjGPv84VuoS2IElGQYrxEr4WPQZd-IvDLz2HsNvtef5mb80AyBznL52i9ogv81SDdUjSUU4KcbqOjlidsfDIRfl98A38cvi9TcaI6oJWVVEou0Q?key=Y28qzmaqJ1Z-tP6GL8WUew\" alt=\"Czechia\u2019s bitcoin scandal: money-laundering or mere mismanagement?\"\/><figcaption class=\"wp-element-caption\">Tom\u00e1\u0161 Jir\u00edkowsk\u00fd (left) in court. Data: \u010cTK.<\/figcaption><\/figure>\n<p>Paroled in 2021, the programmer demanded the return of seized equipment, including a laptop with a bitcoin wallet holding about 1,560 BTC. The case <a href=\"https:\/\/www.seznamzpravy.cz\/clanek\/domaci-kauzy-miliardar-z-trziste-pribeh-zamecnika-ktery-daroval-miliardu-v-bitcoinech-277896\" target=\"_blank\" rel=\"noopener\" title=\"\">stalled in court<\/a> until March 2025, when Jir\u00edkowsk\u00fd, via his lawyer, donated 468 BTC (30%) from the confiscated assets to the government.<\/p>\n<h2 class=\"wp-block-heading\"><strong>The sale sparked public anger<\/strong><\/h2>\n<p>The Ministry of Justice did not rush to liquidate the coins. It converted them into koruna <a href=\"https:\/\/publico.cz\/cesko\/bitcoiny-aukce-ministerstvo-spravedlnosti\" target=\"_blank\" rel=\"noopener\" title=\"\">under its standard procedure<\/a> in cooperation with <span data-descr=\"Agency for the management of state property of the Czech Republic\" class=\"old_tooltip\">\u00daZSVM<\/span> via electronic auctions in 5 BTC tranches from late March to May 27, 2025. The platform was unrelated to Sheep Marketplace but abruptly ceased operations in 2016, soon after Tom\u00e1\u0161 Jir\u00edkowsk\u00fd\u2019s arrest.<\/p>\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh7-qw.googleusercontent.com\/docsz\/AD_4nXdl4FL5VyFHB_2z1yPiEEDsEKotOe2mEcSgznoOuG7CptY1n0ESx6Kb0iP03_7nNaKCMcdKJxzreYWDeNhyGkPaKKtB0e5Nas3ftoocikcNsvMD0iL8qo955utfc83NtbKdbfa_rQ?key=Y28qzmaqJ1Z-tP6GL8WUew\" alt=\"Czechia\u2019s bitcoin scandal: money-laundering or mere mismanagement?\"\/><figcaption class=\"wp-element-caption\">Analysis of Nucleus Market wallets. Data: Arkham Intelligence.<\/figcaption><\/figure>\n<p><a href=\"https:\/\/www.irozhlas.cz\/zpravy-domov\/kauza-bitcoiny-v-penezence-nebyly-3-miliardy-ale-12-informace-ministerstva-o_2505301834_vtk\" target=\"_blank\" rel=\"noopener\" title=\"\">Radio\u017eurn\u00e1l<\/a> claims the bitcoins were sent to the ministry on March 7 in five separate payments in the presence of a notary. Four purportedly came from a Nucleus Market account and one directly from Jir\u00edkowsk\u00fd\u2019s account, which he had funded the day before.<\/p>\n<p>An analysis of the <a href=\"https:\/\/bitinfocharts.com\/bitcoin\/wallet\/NucleusMarket\" target=\"_blank\" rel=\"noopener\" title=\"\">Nucleus Market wallet<\/a> shows it still holds 3,855.15 BTC. This can <a href=\"https:\/\/www.linkedin.com\/pulse\/n%C4%9Bkolik-post%C5%99eh%C5%AF-v-souvislosti-bitcoinov%C3%BDmi-jiri-berger-2xxxf\/?trackingId=JASkX2YIQGmVhMIvNGhpWA%3D%3D\" target=\"_blank\" rel=\"noopener\" title=\"\">be explained<\/a> by the wallet\u2019s era: at the time, access could depend on addresses stored in the wallet file, whereas modern seed phrases provide universal access.<\/p>\n<p>The Den\u00edk N report sparked public outrage. The main opposition force\u2014the right-conservative ANO party\u2014accused the government of corruption and an opaque asset sale.<\/p>\n<p>Deputy party chair Alena Schillerov\u00e1 said there was \u201cno other option but to initiate a vote of no confidence\u201d.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"cs\" dir=\"ltr\">Nem\u00e1me na vybranou. Further anger followed reports that some auction winners are seeking refunds and clarification on possible compensation.<\/p>\n<p>Legal experts and opposition leaders did not rule out that the donation skirted asset-confiscation laws. The National Centre against Organised Crime (NCOZ), overseen by the Prosecutor General\u2019s Office, launched a formal investigation.<\/p>\n<p>Defending himself, Justice Minister Pavel Bla\u017eek <a href=\"https:\/\/www.seznamzpravy.cz\/clanek\/domaci-politika-blazek-nevidi-nic-neetickeho-na-prijeti-bitcoinu-od-odsouzeneho-muze-277856\" target=\"_blank\" rel=\"noopener\" title=\"\">said<\/a> the ministry had never received such a donation before, but would not speculate on its motives:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cWhy can\u2019t a convicted person donate something to the state, possibly as a form of repentance?\u201d<\/p>\n<\/blockquote>\n<p>He also stressed he had no ethical qualms about accepting the donation.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cIf, in the future, the criminal origin of the funds were proven, the state would still confiscate them, and they would be used in the budget. From an ethical point of view, I had nothing to think about,\u201d the minister added.<\/p>\n<\/blockquote>\n<p>In early April Czech police <a href=\"https:\/\/denikn.cz\/1769458\/nejsem-to-schopen-objasnit-proc-si-policie-mysli-ze-darcovy-bitcoiny-pochazi-z-trestne-cinnosti\/?ref=tit1?ref=mpm\" target=\"_blank\" rel=\"noopener\" title=\"\">seized<\/a> an additional 50 BTC from Jir\u00edkowsk\u00fd, worth about 117m koruna, which he had exchanged through the payment service <a href=\"https:\/\/czechdigitalsolutions.cz\/en\/organizations\/ip-wbtcb-solutions-sro\/\" target=\"_blank\" rel=\"noopener\" title=\"\">IP wBTCb solutions<\/a>. According to the Financial Analytical Office, the transaction may have constituted money laundering.<\/p>\n<h2 class=\"wp-block-heading\"><strong>Political fallout<\/strong><\/h2>\n<p>On May 30, under mounting pressure, Bla\u017eek resigned. However, I do not want to damage the reputation of the government or the ruling coalition,\u201d the official said.<\/p>\n<\/blockquote>\n<p>Later Bla\u017eek said the donor received no quid pro quo. According to <a href=\"https:\/\/www.marigold.cz\/item\/jirikovsky-blazek-sheep-nucleus\/\" target=\"_blank\" rel=\"noopener\" title=\"\">journalists<\/a>, Jir\u00edkowsk\u00fd\u2019s equipment had already been returned in January 2025; his March donation therefore \u201cmade no sense\u201d and may have been an attempt to launder funds.<\/p>\n<p>Eva Dekrua was appointed the new justice minister. She pledged to initiate and oversee an independent review of the ministry\u2019s handling of the cryptocurrency sale.<\/p>\n<p>On June 17, during the lower house debate on the no-confidence motion in Prime Minister Petr Fiala\u2019s cabinet, ANO chair Andrej Babi\u0161 <a href=\"https:\/\/denikn.cz\/1762531\/nejvetsi-skandal-v-historii-opozice-tepe-vladu-kvuli-bitcoinum-ta-ji-vini-z-pouhe-predvolebni-kampane\/?ref=list\">called<\/a> the sale of Jir\u00edkowsk\u00fd\u2019s bitcoins \u201cthe biggest scandal in the history of the Czech Republic\u201d.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cIt was an organised operation aimed at laundering dirty money. The operation was planned by the justice minister, the finance minister took part. The prime minister covered it politically,\u201d he said.<\/p>\n<\/blockquote>\n<p>Even so, on June 18 the opposition <a href=\"https:\/\/www.ceskenoviny.cz\/zpravy\/fialova-vlada-odolala-ve-snemovne-dalsimu-pokusu-opozice-o-svrzeni\/2685494\" target=\"_blank\" rel=\"noopener\" title=\"\">fell seven votes short<\/a> (94 of the 101 required) of toppling the government.<\/p>\n<p>The stand-off could have far-reaching consequences and <a href=\"https:\/\/www.economist.com\/europe\/2025\/06\/26\/a-bitcoin-scandal-is-good-news-for-the-czech-donald-trump\" target=\"_blank\" rel=\"noopener\" title=\"\">influence<\/a> the general election on October 3rd-4th.<\/p>\n<h2 class=\"wp-block-heading\"><strong>Grave allegations<\/strong><\/h2>\n<p>The crux of the accusation is that the 468 BTC donated by Tom\u00e1\u0161 Jir\u00edkowsk\u00fd may have been exchanged for inaction by agencies under the Ministry of Justice when it came to seizing his remaining cryptoassets.<\/p>\n<p>As Eliza-Tatiana Baseley, founder of the legal agency Baseley &#038; Partners, told ForkLog, the return of electronic devices\u2014including those to which experts failed to gain access\u2014stemmed from strict evidentiary standards in criminal procedure and the principle of non-interference with private property.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cUnder criminal-procedure standards, the state may retain equipment only if there is evidence that it contains access to bitcoins and that these assets are linked to criminal activity. Assumptions alone are insufficient,\u201d the lawyer noted.<\/p>\n<\/blockquote>\n<p>In her view, Jir\u00edkowsk\u00fd was able to open his bitcoin wallets in the following months. If law enforcement proves the donation to the ministry was given as a guarantee of the inviolability of the remaining funds, then formally it amounts to money laundering.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cCzech law provides no mechanism for a deal in which the state agrees to accept only part of property obtained through crime in exchange for abandoning attempts to seize the rest. Under a plea agreement one can obtain mitigation or deferral of punishment and an instalment plan for fines. But property obtained through crime is always confiscated in full. The court must approve any plea agreement,\u201d Baseley said.<\/p>\n<\/blockquote>\n<p>Thus, in this case the Ministry of Justice is presumably operating beyond permissible legal procedures.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cIf the prosecution\u2019s suspicions are proven, the grounds for initiating a criminal case on the legalisation of proceeds of crime are serious,\u201d the expert concluded.<\/p>\n<\/blockquote>\n<h2 class=\"wp-block-heading\"><strong>Cryptocurrencies and corruption<\/strong><\/h2>\n<p>Czechia\u2019s case, in which cryptocurrency features in alleged corruption schemes, is far from unique.<\/p>\n<p>In October 2024 former Moscow investigator Marat Tambiev <a href=\"https:\/\/forklog.com\/en\/news\/former-investigator-sentenced-to-16-years-for-record-bitcoin-bribe\">was sentenced to 16 years in prison<\/a> and fined 500m rubles for taking a bribe in cryptocurrencies.<\/p>\n<p>According to the case file, he received over 2,718 BTC (7.3bn rubles at the time) and $1.5m from members of the Infraud Organization hacking group in exchange for a promise not to seize their assets. It highlights the risks of integrating cryptocurrencies into public institutions without adequate regulatory foresight, civil-service literacy and operational transparency.<\/p>\n<p>The country recently adopted MiCA, exempting bitcoin holders <a href=\"https:\/\/forklog.com\/en\/news\/czech-republic-eases-tax-burden-for-bitcoin-holders\">from capital-gains tax<\/a>.
