This was announced by Matthew Galeotti, the acting head of the department&#8217;s criminal division.<\/p>\n<p><iframe loading=\"lazy\" width=\"560\" height=\"315\" src=\"https:\/\/www.youtube.com\/embed\/FaOiteqAut8?si=-laIRcrv0ujAU4df\" title=\"YouTube video player\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p>The announcement came weeks after <a href=\"https:\/\/forklog.com\/en\/news\/jury-returns-partial-guilty-verdict-for-tornado-cash-co-founder-crypto-industry-dismayed\">Roman Storm, co-founder of the Tornado Cash mixer, was convicted<\/a> on the same charge. He faces up to five years in prison.<\/p>\n<p>Galeotti clarified the details of the new policy: charges will not be filed if the software is genuinely decentralized, automates P2P transactions, and does not allow developers access to user funds.<\/p>\n<p>He noted that other charges may apply if criminal intent is present.<\/p>\n<p>Jake Chervinsky, chief legal officer at Variant Fund, believes that based on these statements, Storm&#8217;s case should be dismissed.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">The head of DOJ&#8217;s Criminal Division says there will be no Section 1960(b)(1)(C) charges against developers who lack custody and control over user assets.<\/p>\n<p>Roman Storm was just convicted on this exact charge under this exact circumstance. This means it will not affect Storm&#8217;s sentence.<\/p>\n<h2 class=\"wp-block-heading\">Community Reactions<\/h2>\n<p>Amanda Tuminelli, executive director of the DeFi Education Fund, <a href=\"https:\/\/decrypt.co\/336327\/tornado-cash-roman-storm-doj-crypto-charges\">thanked<\/a> the department for &#8220;hearing concerns regarding Section 1960.&#8221;<\/p>\n<p>However, not everyone shared the optimism.
