{"id":62281,"date":"2025-09-05T16:58:44","date_gmt":"2025-09-05T13:58:44","guid":{"rendered":"https:\/\/forklog.com\/en\/?p=62281"},"modified":"2025-09-05T17:00:18","modified_gmt":"2025-09-05T14:00:18","slug":"sec-loses-gary-genslers-correspondence-due-to-it-department-error","status":"publish","type":"post","link":"https:\/\/forklog.com\/en\/sec-loses-gary-genslers-correspondence-due-to-it-department-error\/","title":{"rendered":"SEC Loses Gary Gensler&#8217;s Correspondence Due to IT Department Error"},"content":{"rendered":"<p><span data-descr=\"U.S. Securities and Exchange Commission\" class=\"old_tooltip\">SEC<\/span> <a href=\"https:\/\/www.sec.gov\/files\/sec-oig-review-587-2025.pdf\">lost<\/a> the correspondence of former chairman <a href=\"https:\/\/forklog.com\/en\/news\/gary-genslers-departure-a-retrospective-on-the-sec-chairs-tenure\">Gary Gensler<\/a> from October 2022 to September 2023, which also pertained to crypto regulation.<\/p>\n<p>An internal investigation revealed that &#8220;preventable errors&#8221; by the IT department were to blame.<\/p>\n<p>According to the Office of Inspector General&#8217;s report, the agency&#8217;s information technology department implemented an incorrect automation policy. This led to the complete deletion of data from Gensler&#8217;s work smartphone, including messages and system logs.<\/p>\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/forklog.com\/wp-content\/uploads\/Snimok-ekrana-2025-09-05-163237.webp\" alt=\"Screenshot 2025-09-05 163237\" class=\"wp-image-265164\"\/><figcaption class=\"wp-element-caption\">Timeline of events leading to the loss of Gensler&#8217;s text messages. Source: SEC.<\/figcaption><\/figure>\n<p>The issue was exacerbated by the lack of backups, ignored system alerts, and unresolved software errors. IT specialists were unable to determine why the device stopped syncing with the SEC&#8217;s mobile device management system.<\/p>\n<p>The deleted messages contained information about the SEC&#8217;s enforcement actions against cryptocurrency companies. Some of the correspondence concerned the timing of lawsuits against trading platforms and their founders. This information may be lost to the courts and the public.<\/p>\n<p>Investigators recovered about 1,500 messages from Gensler&#8217;s communications with colleagues. Approximately 38% of them directly related to the Commission&#8217;s work.<\/p>\n<p>During Gensler&#8217;s chairmanship, the SEC actively fined financial institutions for data retention violations. At the time, the head of the agency stated that &#8220;finance depends on trust,&#8221; and failing to keep records undermines it.<\/p>\n<p>The data loss may affect the agency&#8217;s responses to requests under the Freedom of Information Act.
