This view was expressed by ConsenSys founder and one of Ethereum&#8217;s co-founders, Joseph Lubin, in an interview with <a href=\\\"https:\/\/cointelegraph.com\/news\/ethereum-co-founder-joe-lubin-says-no-chance-eth-is-classed-as-security\\\">Cointelegraph<\/a>.<\/p>\n<blockquote class=\\\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\\\">\n<p>&#8220;I think it is equally likely and would have the same impact as if Uber were outlawed. It would provoke a huge backlash not only from the crypto community but also from various politicians and certain regulators,&#8221; he explained.<\/p>\n<\/blockquote>\n<p>In September 2022, Gary Gensler, head of the <span data-descr=\\\"U.S. Securities and Exchange Commission\\\" class=\\\"old_tooltip\\\">SEC<\/span>, indicated that the possibility of <a href=\"https:\/\/forklog.com\/en\/news\/what-is-staking-and-how-to-make-money-from-it\">staking<\/a> a cryptocurrency could pass the <a href=\\\"https:\/\/www.investopedia.com\/terms\/h\/howey-test.asp\\\" target=\\\"_blank\\\" rel=\\\"noreferrer noopener\\\">Howey test<\/a>, which is used to determine whether something is a security. The statement came after <a href=\"https:\/\/forklog.com\/en\/news\/ethereum-activates-the-merge-blockchain-shifts-to-pos\">activation of The Merge update<\/a> on the Ethereum mainnet.<\/p>\n<p>According to Lubin, he &#8220;spent many years&#8221; participating in discussions with the SEC and the Commodity Futures Trading Commission. About five years ago regulators &#8220;were simply trying to understand what tokens are,&#8221; he added.<\/p>\n<blockquote class=\\\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\\\">\n<p>&#8220;Back then they thought that all [cryptocurrencies and tokens] fit the definition of a security. We, I think, helped them understand better that many tokens are not securities, and then they left, and now Gary [Gensler] and the team think that almost everything is a security,&#8221; Lubin noted.<\/p>\n<\/blockquote>\n<p>However, the founder of ConsenSys emphasised that Ethereum remains &#8220;quite decentralised&#8221; and has &#8220;a range of use cases&#8221; that exclude designation as a security.<\/p>\n<blockquote class=\\\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\\\">\n<p>&#8220;There is no central set of promoters or developers who are deliberately trying to boost the price of ETH and enrich investors. In the United States there is a legal system that, I think, would support the arguments that will be advanced that this is not the case,&#8221; Lubin concluded.<\/p>\n<\/blockquote>\n<p>In December 2020, <a href=\"https:\/\/forklog.com\/en\/news\/sec-files-suit-against-ripple\">SEC filed a lawsuit against Ripple<\/a>, accusing the company of selling unregistered securities.<\/p>\n<p>Later Fox Business published <a href=\"https:\/\/forklog.com\/en\/news\/media-point-to-potential-conflicts-of-interest-in-sec-case-against-ripple\">a wide-ranging investigation<\/a> into the case. Journalists concluded that the people behind bringing the suit could have been affiliated with Ethereum.<\/p>\n<p>Empower Oversight, a nonprofit, also pointed to a potential conflict of interest in the actions of former senior officials of the Commission.<\/p>\n<p>Lawyers for Ripple for most of the proceedings <a href=\"https:\/\/forklog.com\/en\/news\/sec-declines-to-disclose-internal-documents-in-ripple-case\">tried<\/a> to obtain internal SEC documents \u2014 the text of Hinman\u2019s 2018 speech.
