This follows from the special section of the <a href=\"https:\/\/www.fca.org.uk\/publication\/guidance-consultation\/gc23-2.pdf\" title=\"new guidance\">new guidance<\/a> <span data-descr=\"UK Financial Conduct Authority\" class=\"old_tooltip\">FCA<\/span>.<\/p>\n<p><!--more--><\/p>\n<p>They complement the recently enacted <a href=\"https:\/\/forklog.com\/en\/news\/britain-approves-financial-services-and-markets-bill\">Financial Services and Markets Act<\/a>, affecting regulation of the cryptocurrency sector in the United Kingdom.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\n<cite><em>\u00ab[Section] S21 [\u2026] applies even in cases where the message originates abroad, if it is capable of affecting the territory of the country\u00bb,<\/em> <em>\u2014 <\/em>the document states.<\/cite><\/p><\/blockquote>\n<p>In <a href=\"https:\/\/www.theblock.co\/post\/240231\/fca-crypto-memes-breach-financial-promotion-rules\">The Block<\/a> they suggested that creators of crypto-asset advertising may need to include a disclaimer.<\/p>\n<p>The updated rules could prove critical for meme-token projects that are based on related memes, the publication notes.<\/p>\n<p>The document also discusses extending S21 to &#8220;finfluencers&#8221; \u2014 financial-influencers.<\/p>\n<p>According to the FCA, posts on Reddit and Telegram may contain inadvertent advertising, and finfluencers \u2014 may not realise that they are subject to the S21 restrictions.<\/p>\n<p>Earlier, the FCA<a href=\"https:\/\/forklog.com\/en\/news\/uk-regulator-sets-start-date-for-crypto-advertising-regime\"> warned<\/a> participants of the crypto industry about the need to comply with the advertising regime, which will come into force on 8 October 2023.<\/p>\n<p>In May, UK authorities warned that, as part of the fight against fraud and cybercrime<a href=\"https:\/\/forklog.com\/en\/news\/britain-to-ban-cold-calls-for-cryptocurrency-advertising\"> will ban cold calls<\/a>, used in selling financial products, including digital assets.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Advertisements that violate crypto-asset advertising rules face unlimited fines and up to two years in prison.
