{"id":82125,"date":"2023-07-25T10:20:38","date_gmt":"2023-07-25T07:20:38","guid":{"rendered":"https:\/\/forklog.com\/en\/?p=82125"},"modified":"2025-09-12T03:14:32","modified_gmt":"2025-09-12T00:14:32","slug":"binance-files-motion-to-dismiss-cftc-lawsuit","status":"publish","type":"post","link":"https:\/\/forklog.com\/en\/binance-files-motion-to-dismiss-cftc-lawsuit\/","title":{"rendered":"Binance files motion to dismiss CFTC lawsuit"},"content":{"rendered":"<p>The cryptocurrency exchange Binance and its chief executive Changpeng Zhao have filed a <a href=\\\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ilnd.431767\/gov.uscourts.ilnd.431767.53.0_1.pdf\\\">motion<\/a> to dismiss the existing <span data-descr=\\\"U.S. Commodity Futures Trading Commission\\\" class=\\\"old_tooltip\\\">CFTC<\/span> complaint in federal court in Chicago.<\/p>\n<p>On 27 March 2023 the regulator<a href=\"https:\/\/forklog.com\/en\/news\/cftc-files-suit-against-binance-and-changpeng-zhao\"> accused<\/a> the trading platform of violating derivatives trading rules and operating without a licence. The agency also asserts that the company was aware that its customers include sanctioned individuals.<\/p>\n<p>According to the statement, Binance&#8217;s former chief compliance officer Samuel Lim also intends to file a motion to dismiss the complaint. <\/p>\n<p>Currently Binance, Zhao and Lim must submit their responses to the CFTC&#8217;s complaint by 27 July. They asked to increase the number of pages in their memoranda, &#8220;in light of the complexity of the claims and the number of arguments the defendants expect to present in support of their motions to dismiss&#8221;.<\/p>\n<div class=\\\"wp-block-text-wrappers-update-2 article_update\\\"><time class=\\\"gtb_text-wrappers_update_time\\\">28 July 2023 | 09:09<\/time><span class=\\\"gtb_text-wrappers_update_head\\\">Update: <\/span><\/p>\n<p>Binance, Lim and Zhao filed a <a href=\\\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ilnd.431767\/gov.uscourts.ilnd.431767.59.0.pdf\\\" >response<\/a> as part of the motion to dismiss the CFTC&#8217;s suit, which alleges that the Commission exceeded its authority by suing the exchange.<\/p>\n<p>The document states that the case targets foreign individuals and entities who reside and operate outside the United States, and that some of the regulator&#8217;s accusations do not meet legal standards.<\/p>\n<blockquote class=\\\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\\\">\n<p>\u00abThe cornerstone of our rule of law is that, as a rule, \\\\\\&#8221;the laws of the United States operate within the country, but do not govern the world\\\\\\&#8221;. \u2026 The CFTC resorts to a muddle of legal theories that rely on competing and contradictory registration categories, advances new and unfounded claims under a regulatory regime that has never before been used, and relies on assertions that have no bearing on the case under the agency&#8217;s own leadership. The court should reject the CFTC&#8217;s attempt to regulate the situation through coercive enforcement\u00bb, the document states.<\/p>\n<\/blockquote>\n<\/div>\n<p>In the CFTC <a href=\"https:\/\/forklog.com\/en\/news\/cftc-chief-says-binance-deliberately-violated-regulators-rules\">claimed<\/a>, that Binance intentionally violated the rules. In response to the allegations Zhao <a href=\"https:\/\/forklog.com\/en\/news\/changpeng-zhao-calls-cftc-lawsuit-unexpected-and-disappointing\">noted<\/a> that the regulator&#8217;s claims contain &#8220;incomplete account of facts&#8221; and his company does not agree with many of the points&#8217; characterisations. Going forward he<a href=\"https:\/\/forklog.com\/en\/news\/changpeng-zhao-criticises-mandatory-cryptocurrency-regulation\"> condemned<\/a> &#8220;coercive crypto-regulation&#8221; by regulators. <\/p>\n<p>On 5 June <span data-descr=\\\"U.S. Securities and Exchange Commission\\\" class=\\\"old_tooltip\\\">SEC<\/span> <a href=\"https:\/\/forklog.com\/en\/news\/sec-files-suit-against-binance-and-changpeng-zhao\">filed<\/a> suit against Binance and Zhao. The agency brought 13 charges, including the sale of unregistered securities. On 6 June the regulator <a href=\"https:\/\/forklog.com\/en\/news\/sec-seeks-to-freeze-assets-held-by-binance-us\">filed<\/a> a motion to freeze the exchange&#8217;s US-domiciled assets.<\/p>\n<p>On 9 June users of Binance.US <a href=\"https:\/\/forklog.com\/en\/news\/binance-us-to-suspend-usd-deposits\">lost the ability to deposit<\/a> dollars, prompting selling by those looking to withdraw their funds in fiat. In light of this, the exchange <a href=\"https:\/\/forklog.com\/en\/news\/bitcoin-trades-at-a-discount-on-binance-us\">saw a discount in the Bitcoin quotes against the US dollar \u2014 the figure reached about $2,200 (7.3%).<\/p>\n<p>Earlier, on 17 June the SEC and Binance <a href=\"https:\/\/forklog.com\/en\/news\/sec-and-binance-strike-deal-over-customer-assets-in-the-united-states\">reached<\/a> an agreement regarding client funds in the United States.
