{"id":82328,"date":"2023-07-28T15:23:54","date_gmt":"2023-07-28T12:23:54","guid":{"rendered":"https:\/\/forklog.com\/en\/?p=82328"},"modified":"2025-09-12T04:20:43","modified_gmt":"2025-09-12T01:20:43","slug":"swiss-crypto-broker-bity-sues-finma","status":"publish","type":"post","link":"https:\/\/forklog.com\/en\/swiss-crypto-broker-bity-sues-finma\/","title":{"rendered":"Swiss crypto broker Bity sues FINMA"},"content":{"rendered":"<p>The crypto broker Bity <a href=\"https:\/\/btcpay.nymte.ch\/LocalStorage\/5ec1e14d-86b9-4c62-964e-4da2612bd5b1-finma_case.pdf\">filed a lawsuit<\/a> against the Swiss Financial Market Supervisory Authority (FINMA) over unjustified limits on digital-asset operations.<\/p>\n<p>The firm announced the suit when it launched a <a href=\"https:\/\/btcpay.nymte.ch\/apps\/2aks2XSx8ogQFc2CPuKVben8KNcP\/crowdfund\">crowdfund<\/a> to cover legal costs.<\/p>\n<p>Bity challenged the monthly limit of 1,000 <span data-descr=\"Swiss franc\" class=\"old_tooltip\">CHF<\/span> (~$1,152) on cryptocurrency transactions for customers who had not completed <span data-descr=\"Know Your Customer\" class=\"old_tooltip\">KYC<\/span> procedures. The previous limit was 5,000 CHF (~$5,762).<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;FINMA fights not as openly as the <span data-descr=\"the U.S. Securities and Exchange Commission\" class=\"old_tooltip\">SEC<\/span> in the United States, but more insidiously. The regulator uses all its soft power to change the law undemocratically. This must stop,&#8221; said representatives of Bity.<\/p>\n<\/blockquote>\n<p>In November 2022, FINMA <a href=\"https:\/\/forklog.com\/en\/news\/switzerland-to-require-verification-for-cryptocurrency-transactions\">revised its AML rules<\/a> to combat money laundering and included digital assets, lowering the minimum amount for these transactions for unverified users.<\/p>\n<p>According to the broker&#8217;s filing, the regulator began to treat all crypto transactions as high risk, since they could facilitate criminal schemes. Because of these rules, the industry is forced to apply more complex security systems, which &#8220;undermines the usability of digital assets&#8221;, the company&#8217;s representatives said.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;To implement the latest change, FINMA didn&#8217;t even bother issuing a regulation. They sent a simple email, referring to the Swiss edition Blick.
