He has been charged with smuggling AI chips to China worth $2.5 billion, according to a <a href=\"https:\/\/www.justice.gov\/opa\/pr\/three-charged-conspiring-unlawfully-divert-cutting-edge-us-artificial-intelligence\">press release<\/a> from the Department of Justice.<\/p>\n<p>Other accused individuals include Rui-Zang &#8220;Steven&#8221; Chang, general manager of Super Micro&#8217;s Taiwan office (currently wanted), and third-party broker Ting-Wei &#8220;Willy&#8221; Sun (detained).<\/p>\n<p>According to the investigation, the suspects misled inspectors, forged documents, and used complex transit shipping schemes involving an intermediary company to conceal the true destination of the AI chips.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;Such schemes generate billions of dollars in illegal profits and pose a direct threat to US national security,&#8221; stated Jay Clayton, prosecutor for the Southern District of New York.<\/p>\n<\/blockquote>\n<p>Authorities claim that the accused and others conspired to systematically redirect servers from the American manufacturer with specific <span data-descr=\"graphics processing units\" class=\"old_tooltip\">GPU<\/span> to China without a license from the Department of Commerce. The scheme operated as follows:<\/p>\n<ol class=\"wp-block-list\">\n<li>Liao and Chang instructed executives of a company in Southeast Asia to place orders with the US manufacturer for servers.<\/li>\n<li>The systems were assembled in the US, then shipped to facilities in Taiwan, and from there to the company involved in the case in other Southeast Asian countries.<\/li>\n<li>The firm then repackaged the servers in unmarked boxes to conceal their contents before shipping them to final destinations in China.<\/li>\n<\/ol>\n<p>Between 2024 and 2025, the company purchased equipment worth $2.5 billion from the US manufacturer.<\/p>\n<p>Authorities reported that the accused and their accomplices took extensive measures to conceal the scheme. They manufactured thousands of fake servers to deceive American compliance auditors.<\/p>\n<p>Surveillance footage shows Sun personally overseeing the process of replacing serial number stickers, with employees using a hairdryer for the task.<\/p>\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/forklog.com\/wp-content\/uploads\/img-4ec75131646d56d0-9235339040643876.webp\" alt=\"image\" class=\"wp-image-277158\"\/><figcaption class=\"wp-element-caption\">Sun above, one of the scheme participants below. Source: US Department of Justice Public Affairs Office.<\/figcaption><\/figure>\n<p>Liao, Chang, and Sun are charged with three counts of conspiracy to:<\/p>\n<ul class=\"wp-block-list\">\n<li>violate the Export Control Reform Act (maximum penalty of 20 years imprisonment);<\/li>\n<li>smuggle goods from the US (up to five years);<\/li>\n<li>defraud the United States (up to five years).<\/li>\n<\/ul>\n<h2 class=\"wp-block-heading\">Rumors of Smuggling<\/h2>\n<p>Reports of smuggling banned export chips have surfaced over the past few years.<\/p>\n<p>In December 2024, media <a href=\"https:\/\/www.reuters.com\/technology\/us-asks-nvidia-super-micro-investigate-how-chips-ended-up-china-information-2024-12-19\/\">reported<\/a> that the US Department of Commerce approached Nvidia to determine how the corporation&#8217;s products ended up in China.<\/p>\n<p>In turn, the tech giant asked major distributors \u2014 Super Micro and Dell Technologies \u2014 to vet their clients in Southeast Asia.<\/p>\n<p>At that time, five different participants in the smuggling scheme claimed they &#8220;managed to avoid detection during Super Micro&#8217;s inspections.&#8221;<\/p>\n<p>In July 2025, it <a href=\"https:\/\/www.ft.com\/content\/6f806f6e-61c1-4b8d-9694-90d7328a7b54?syn-25a6b1a6=1\">became known<\/a> that chips worth about $1 billion were smuggled into China within just three months following the tightening of export controls by the Trump administration.<\/p>\n<p>According to the Financial Times, the B200 became the most popular and accessible processor on the black market.<\/p>\n<p>In December, new rumors of smuggling emerged. At that time, Nvidia <a href=\"https:\/\/forklog.com\/en\/news\/nvidia-to-track-chips-amid-smuggling-allegations-to-china\">developed<\/a> technology to verify the location of its processors.<\/p>\n<p>The feature was introduced privately and offered to clients as an option. The tool uses &#8220;confidential computing capabilities of graphics processors.&#8221;<\/p>\n<p>The software is designed to &#8220;track the overall performance of the chip.&#8221; This is reportedly standard practice among companies that purchase processors in large batches for major data centers.<\/p>\n<p>The location of semiconductors is determined by analyzing the latency in data exchange with Nvidia servers.
