Russian court dismisses claim to recover 16.6 BTC

The Savelovsky Court in Moscow has dismissed the claim to recover 16.6 BTC from unlawful possession. The plaintiff’s attorney, Boris Bashilov, said this, according to «РИА Новости».

According to him, the hearing lasted an hour, the judge spent ‘a long time’ in the deliberation room, but ultimately denied the claim.

The plaintiff intends to appeal the decision.

Earlier in May, it became known that the Savelovsky Court will hear a claim for the return of cryptocurrency from unlawful possession.

According to the plaintiff, in the summer of 2018 he transferred bitcoins to his acquaintance Igor Tukin under trust management. He was to invest the assets for five months and then return them to the owner, taking 20% of the profits from the investment.

However, later he stated that he had lost the cryptocurrency and did not return it. The owner of the bitcoins sent a pre-trial claim, and then a court lawsuit.

At the time the claim was filed, the value of the transferred bitcoins was estimated at nearly 45 million rubles; at the time of writing, more than 78 million.

Back then, Bashilov said the case could set a precedent, as such cases had not been considered previously due to lack of regulation. However, on 1 January the law “On Digital Financial Assets” came into force, recognising cryptocurrencies as property.
